Please read these Terms carefully before using SwadSync. They govern your access to and use of our platform and services.

1Acceptance of Terms
By accessing or using SwadSync ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you may not use the Service.
These Terms apply to all users of the Service, including restaurant owners, managers, staff members, and any other individuals accessing the platform on behalf of a business.
2Description of Service
SwadSync provides a cloud-based restaurant point-of-sale platform that includes order management, table management, inventory tracking, payment processing, staff management, analytics, and related services ("Service").
The Service is provided on a subscription basis. Features available to you depend on the subscription plan you have selected. SwadSync reserves the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3User Accounts & Registration
To use the Service, you must create an account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify SwadSync immediately of any unauthorized access
You must be at least 18 years old to create an account. Accounts registered on behalf of a business must be authorized by that business.
4Subscription, Billing & Payment
SwadSync operates on a subscription model. By subscribing, you authorize us to charge your designated payment method on a recurring basis (monthly or annual, as selected).
All fees are exclusive of applicable taxes. Subscription fees are non-refundable except as stated in our Refund Policy. We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
Failed payments may result in service suspension after a 7-day grace period.
5Data Ownership & Privacy
You retain full ownership of your business data — including menu items, orders, transactions, customer records, and staff information — uploaded to or generated through the Service.
SwadSync does not sell your data to third parties. We process your data only to provide and improve the Service, as described in our Privacy Policy.
Upon account closure, you may request a full data export within 30 days. After 30 days, we may permanently delete your data.
6Acceptable Use
You agree not to use the Service to:
• Violate any applicable laws or regulations
• Process fraudulent or unauthorized transactions
• Reverse engineer, decompile, or attempt to extract the source code
• Resell or sublicense the Service without written permission
• Transmit malware, viruses, or any harmful code
• Interfere with the operation of the Service or other users' access
• Impersonate SwadSync or any affiliated employee
Violations may result in immediate account suspension without refund.
7Intellectual Property
The SwadSync platform, including all software, design, trademarks, logos, and content, is the exclusive property of Modern Tech Creations and is protected by copyright, trademark, and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business operations only. Nothing in these Terms transfers any intellectual property rights to you.
8Third-Party Integrations
SwadSync may integrate with third-party services (payment processors, delivery platforms, accounting software, etc.). These integrations are governed by the respective third parties' terms and privacy policies.
SwadSync is not responsible for the availability, accuracy, or conduct of third-party services. You use such integrations at your own risk.
9Limitation of Liability
To the maximum extent permitted by law, SwadSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of the Service.
Our total aggregate liability to you for any claims related to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
10Indemnification
You agree to indemnify, defend, and hold harmless SwadSync and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from:
• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or third-party right
• Content or data you submit to the Service
11Termination
Either party may terminate these Terms at any time. You may cancel your subscription through your account settings or by contacting support. SwadSync may suspend or terminate your account immediately for material breach of these Terms.
Upon termination, your right to use the Service ceases immediately. You remain responsible for all charges incurred before termination.
12Changes to These Terms
SwadSync reserves the right to update these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
13Governing Law & Disputes
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.
